A guardianship is typically established through a judicial process for an individual if he or she is unable to make sound decisions due to minority or disability with respect to their medical care, housing or general welfare.

A conservatorship is typically established through a judicial process for an individual if he or she is unable to make sound decisions relative to their finances or property because of minority or disability.

Individuals that have disabilities or are of a certain age are more susceptible to abuse, neglect, undue influence, scams and frauds. South Dakota has statutes that protect this vulnerable population. I have tried many cases to successfully recover money, property and obtain damage awards against those responsible for financial and physical abuse of vulnerable adults.
